4. LIMITATION OF LIABILITY

Neither party shall be liable for any indirect, incidental,

or consequential damages arising under this Agreement.

The aggregate liability of either party shall not exceed[X].

7. INDEMNIFICATION

Respondent shall indemnify and hold harmless the Claimant from any loss, liability, or claim arising from activities prior to the Effective Date. O'Brien §7.2
