13.4The Customer may withhold any amount disputed in good faith under clause 13.2 until the dispute is resolved.
14LIMITATION OF LIABILITY
14.1Neither party is liable to the other for any indirect or consequential loss, including loss of profit, revenue or data, however arising.
14.2Subject to clauses 14.3 and 14.4, each party’s total aggregate liability under or in connection with this Agreement is limited to the Fees paid or payable by the Customer in the twelve (12) months preceding the event giving rise to the claim.
14.3The limitation in clause 14.2 does not apply to liability for death or personal injury, fraud or wilful misconduct.
14.4Nothing in this clause 14 limits the Supplier’s liability for any Data Breach, or for any breach of clause 11 (Privacy and Data Security), which liability is unlimited.
14.5Each party must take reasonable steps to mitigate any loss it suffers or incurs under or in connection with this Agreement.
